THOMAS CREED
This is the last Will and Testament of me Thomas Creed of the Town and County of Southampton Draper I hereby revoke all former testamentary dispositions I appoint Charles Edwards of No 40 St Johns Wood Park Gentleman Arthur Isbell of Bishopstoke in the County of Southampton Gentleman and Robert Sale Smith of No7 Belle Vue Place in the said Town and County of Southampton (who when hereinafter mentioned are called my "Trustees") Executors and Trustees of this my will And I bequeath unto each of my Trustees who shall act in the Executorship and Trusteeship of this my will And I bequeath unto each of my Trustees who shall act in the Executorship and Trusteeship of this my will the sum of Nineteen Pounds Nineteen shillings I bequeath unto my wife Mary Creed the sum of One hundred pounds to be paid to her immediately after my decease I also bequeath unto my said wife absolutely all Wines Spirits and Consumable Stores and my and her wearing apparel Jewellery and Trinkets that may be at my private residence at the time of my decease And I direct that my Trustees shall allow my said wife to have the use of all Articles of Furniture Plate Linen China and other household Effects during her life and upon her Death such Articles shall be sold by the Trustees and the proceeds of such sale shall form part of my residuary Estate I bequeath unto my Daughter Rosa Fanny Creed an annuity or clear sum of One hundred Pounds during the joint lives of herself and my said wife free of Legacy or annuity duty and I further direct that such annuity shall be paid quarterly and that the first payment shall be made at the expiration of three months after my decease And I direct the moneys which under my Articles of Partnership are upon my decease payable to my Estate by my surviving Partner in respect of my share of the Goodwill of the said business which my surviving Partner may be willing to pay for the right to carry on the said business instead of winding the same up shall fall into and form part of my residuary estate I devise and bequeath unto and to the use of my Trustees their heirs executors and assigns all the rest and residue of my property whatsoever including my Life Policy in the National Provident Institution (except trust or mortgage estates) In trust to sell such parts thereof as shall be saleable and out of the net proceeds of such sale and out of the money and securities of which I may be possessed at my death to pay my Funeral Mourning and Testamentary expenses and Debts and the Legacies given by me and to invest the residue of such proceeds and money in the names or under the Control of the Trustees for the time being of this my Will in the Public Stocks or Funds of Great Britain or at Interest on Government or Real or Leasehold Securities in England or in the Preference or Guaranteed Shares or Stocks or in the Debentures or Debenture Stock of any Railway Company in the United Kingdom, or India or in Colonial Securities or in purely personal Security with power to vary the same at discretion And I declare that the said Trustees for the time being shall stand possessed of my Residuary Estate and the proceeds thereof and the securities in or upon, which the same shall be invested upon the trusts following (that is to say) upon trust thereout in the first instance to pay the said annuity of One hundred pounds hereinbefore given to my said Daughter Rosa Fanny Creed as such from time to time become due upon trust during the life of my said wife to pay the annual Income of the said trust funds to my said wife and after her death the Trustees for the time being shall stand possessed of the said trust funds and the annual income thereof Upon trust thereout to pay unto my Sister Marian Creed the Interest of Three hundred pounds to be paid so long as she lives and in their opinion is in need thereof and then in either event the said sum of Three hundred pounds is to be paid to my Daughter Rosa Fanny Creed absolutely and Upon trust to pay to my said Daughter Rosa Fanny Creed the sum of Two hundred pounds free of legacy duty as also the legacy to Marian Creed free of legacy duty Upon trust to pay to my Granddaughter Clara Angela Creed the sum of Three hundred pounds free of legacy duty Upon trust to pay to Emma Millard (the widow of Edward Millard) the sum of Fifty pounds free of duty and Upon trust (after bringing into Hotchpotch any sums of money at my decease respectively standing to the debit of any of my Children hereinafter named in my Private Ledger) to divide the same into five equal parts and the said Trustees the same respectively to my five Children Emma Mary Arding Rosa Fanny Creed Ellen Lydia Isbell Angela Snodin Breton Edward Hawke Hodges Creed their respective Executors administrators and assigns I hereby further declare that it shall be lawful for my Trustees for the time being to advance to my said son Edward Hodges Creed any portion of his presumptive share they may in their uncontrolled discretion think for his advantage and furtherance in life And I declare that any Annuity Legacy or share of Residuary Estate bequeathed to any person who at the time of my decease or at any time afterwards shall be a married woman shall be paid to her for her sole and separate use so as to be free from the debts contracts control or engagements of her Husband And I hereby authorize and empower the said Trustees to make any arrangements which to them may seem fitting and reasonable for the settlement and adjustment with my surviving partner of my right and liabilities in respect of my said business with full power to accept an agreed or estimated Sum as the value of my share and interest in the said business and for accepting payment for the same at such terms and on such terms as they may think proper without being liable for any loss which may be occasioned thereby And I declare that this present power may be exercised either in conjunction with or independently of any provision for similar objects contained in any deed or articles of regulating my Copartnership Business And I further declare that it is my will that all vacancies occurring in the Trusteeship of this my Will shall be filled up as soon as conveniently may be and it is my particular desire that the number of Trustees of this my Will shall never be less than two I devise and bequeath unto and to the use of my Trustees their Executors administrators and assigns all Estates vested in me as a Trustee or Mortgagee subject to the trusts and equities affecting the same respectively In witness whereof I the said Thomas Creed the Testator have to this my last Will and Testament contained in three sheets of paper set my hand this twenty third day of October in the year of our Lord One thousand and seventy four.

The Testator Thomas Creed was late of the Town and County of the Town of Southampton Draper and died on the twenty fourth day of October 1874 at No3 Carlton Crescent Southampton aforesaid
